Freelancer income tax kaise file kare? अगर आप freelancing, consulting, content creation, designing, coding, digital services या किसी दूसरे independent काम से कमाते हैं, तो आपकी tax filing salary वाले taxpayer से अलग हो सकती है। Freelancer की income आम तौर पर business या profession की income के रूप में report की जाती है, इसलिए सही ITR form, income calculation, TDS credit, expenses और tax regime को समझना जरूरी है।
सबसे पहले एक जरूरी बात: “Freelancer” कोई अलग ITR category नहीं है। आपकी actual activity और income की nature तय करती है कि आपको ITR-3, ITR-4 या किसी दूसरे applicable form का इस्तेमाल करना है। AY 2026-27 के लिए Income Tax Department की official guidance के अनुसार business/profession income वाले taxpayers के लिए ITR-3 और eligible presumptive taxpayers के लिए ITR-4 उपलब्ध हैं।

Freelancer Income Tax कैसे काम करता है?
मान लीजिए आप graphic designer हैं और अलग-अलग clients के लिए काम करते हैं। आपकी client payments, online platform receipts, consulting fees या project payments आपकी gross receipts का हिस्सा हो सकती हैं। इसके बाद applicable tax rules के अनुसार taxable professional/business income निकाली जाती है।

Freelancer को कौन-सा ITR Form भरना चाहिए?
सबसे common confusion यही होता है कि freelancer ITR-1 भरे या ITR-3/ITR-4। अगर आपकी income में business या profession शामिल है, तो ITR-1 सामान्यतः सही form नहीं होता। AY 2026-27 में business/profession income वाले individual के लिए ITR-3 applicable है, जबकि eligible resident taxpayers जो presumptive taxation के तहत income declare करते हैं, वे ITR-4 का इस्तेमाल कर सकते हैं।

Section 44ADA क्या है और Freelancer के लिए कब काम आ सकता है?
Section 44ADA eligible specified professionals के लिए presumptive taxation scheme देता है। Income Tax Department के अनुसार specified profession से eligible gross receipts सामान्यतः ₹50 लाख तक हो सकते हैं, और अगर cash receipts कुल gross receipts के 5% से अधिक नहीं हैं तो threshold ₹75 लाख तक बढ़ सकती है। Presumptive income सामान्यतः gross receipts का 50% मानी जाती है।
Specified professions में legal, medical, engineering, architecture, accountancy, technical consultancy, interior decoration और CBDT द्वारा notified अन्य professions शामिल हैं। इसलिए “मैं freelancer हूं” कहना अकेले 44ADA eligibility साबित नहीं करता। आपकी actual professional activity देखना जरूरी है।
44ADA का आसान Example
मान लीजिए आपकी eligible professional gross receipts FY 2025-26 में ₹12 लाख हैं और आप 44ADA की conditions पूरी करते हैं। Presumptive income का basic calculation होगा:
₹12,00,000 × 50% = ₹6,00,000
Presumptive scheme में expenses का अलग से deduction claim नहीं किया जाता क्योंकि applicable presumptive percentage में expenses deemed to be covered माने जाते हैं। हालांकि eligible Chapter VI-A deductions अलग rules के अनुसार available हो सकती हैं।
हर Freelancer को 44ADA ही चुनना चाहिए?
नहीं। अगर आपकी activity Section 44AA की specified profession में नहीं आती, तो 44ADA अपने-आप available नहीं हो जाती। कुछ freelance activities business nature की हो सकती हैं और अलग provisions apply हो सकते हैं, जबकि कुछ cases में regular books और actual-profit computation ज्यादा appropriate हो सकता है।
अगर आप 44ADA की eligibility को लेकर स्पष्ट नहीं हैं, तो अपने profession की exact nature और receipts के आधार पर qualified tax professional से confirm करना बेहतर है। Income Tax Department की official business/profession guidance भी देखें। गलत presumptive section चुनना बाद में compliance issue पैदा कर सकता है।
Freelancer Income Tax File करने से पहले कौन-से Documents तैयार रखें?

Gross Freelance Receipts − Eligible Business/Professional Expenses = Taxable Business/Professional Profit
उदाहरण के लिए, अगर annual receipts ₹10 लाख हैं और applicable, properly supported business expenses ₹2 लाख हैं, तो basic profit ₹8 लाख हो सकता है। लेकिन actual tax calculation में depreciation, other income, losses, deductions, special-rate income और applicable rules जैसे factors भी देखे जा सकते हैं।
Presumptive Taxation
Eligible 44ADA case में example के तौर पर ₹10 लाख gross professional receipts पर basic presumptive income ₹5 लाख होगी:
₹10,00,000 × 50% = ₹5,00,000
इसके बाद आपकी total income, tax regime और अन्य applicable provisions के आधार पर final tax liability calculate होगी।
AY 2026-27 में Freelancer के लिए New Tax Regime और Old Tax Regime
AY 2026-27 में new tax regime default है। लेकिन business/profession income वाले eligible taxpayers जो old tax regime चुनना चाहते हैं, उन्हें Form 10-IEA से संबंधित नियमों का पालन करना होता है। Income Tax Department के अनुसार business/profession income वाले व्यक्ति को old regime opt करने के लिए Form 10-IEA specified due date तक furnish करना होता है।
New regime में AY 2026-27 के लिए individual slabs ₹4 लाख तक nil, फिर ₹4–8 लाख पर 5%, ₹8–12 लाख पर 10%, ₹12–16 लाख पर 15%, ₹16–20 लाख पर 20%, ₹20–24 लाख पर 25% और ₹24 लाख से ऊपर 30% हैं। Eligible taxpayers को Section 87A के तहत new regime में ₹12 लाख तक total income पर up to ₹60,000 rebate मिल सकती है, subject to the applicable conditions.

Freelancer ITR Online कैसे File करें? Step-by-Step Process
Step 1: Income Tax e-Filing Portal पर Login करें
Income Tax e-Filing portal पर PAN credentials से login करें। अपनी profile, contact details और bank account की जानकारी भी review कर लें।
Step 2: सही Assessment Year चुनें
FY 2025-26 में कमाई हुई income के लिए AY 2026-27 select करें। FY 2025-26 में कमाई हुई income के लिए AY 2026-27 की return Income-tax Act, 1961 के तहत file होती है। इसलिए सही Assessment Year select करना जरूरी है।
Step 3: सही ITR Form चुनें
अगर आप regular business/profession income report कर रहे हैं, तो ITR-3 लागू हो सकता है। अगर आप ITR-4 की सभी eligibility conditions satisfy करते हैं और presumptive taxation choose कर रहे हैं, तो ITR-4 इस्तेमाल किया जा सकता है।
Step 4: Pre-filled Data Check करें

Final tax liability निकलने के बाद payable tax, TDS, advance tax और self-assessment tax को reconcile करें। अगर tax payable है, तो applicable payment complete करने के बाद return में सही challan details capture करें।

Step 9: ITR e-Verify करें
ITR filing complete होने के बाद e-Verification पूरा करना जरूरी है। उपलब्ध verification method आपके account और portal options के अनुसार हो सकता है। Verification status को portal पर confirm करें और acknowledgement सुरक्षित रखें।
Freelancer को Advance Tax कब देना पड़ता है?
अगर आपकी estimated tax liability rules के अनुसार advance tax payment trigger करती है, तो साल के दौरान advance tax planning करना जरूरी हो सकता है। Section 44ADA अपनाने वाले eligible professionals के लिए Income Tax Department की guidance के अनुसार 100% advance tax 15 March तक pay किया जाना है। 31 March तक किया गया payment भी relevant financial year का advance tax माना जाता है।
Advance tax ignore करने से interest liability बन सकती है। इसलिए freelancer को year-end पर पहली बार tax calculate करने के बजाय income और TDS को पूरे साल track करना चाहिए।
AY 2026-27 में Freelancer की ITR Due Date क्या है?
Income earned during FY 2025-26 की AY 2026-27 return के लिए business/profession income वाले taxpayers की due date taxpayer category के अनुसार अलग हो सकती है। Official transition FAQ के अनुसार business/profession income वाले जिन cases में accounts audit के लिए required नहीं हैं, उनके लिए due date 31 August है। Audit वाले applicable cases के लिए अलग timeline है।
इसलिए “हर freelancer की deadline 31 July होती है” मान लेना सही नहीं है। अपनी exact return category और audit status देखकर due date confirm करें।
अगर original due date निकल चुकी है, तो belated return की applicable window और late fee/interest rules भी check करें। Filing के समय Income Tax Department की latest notices और portal instructions जरूर देखें।
Freelancer की 8 Common Tax Mistakes
1. Personal और freelance income को बिना reconciliation के mix करना
अलग records maintain करने से reporting और reconciliation ज्यादा आसान होती है।
2. हर freelancer को 44ADA eligible मान लेना
44ADA specified professions और prescribed conditions के लिए है। Activity की exact nature देखना जरूरी है।
3. TDS को income नहीं मानना या दोबारा/गलत report करना
TDS credit को 26AS और AIS से match करें और gross receipts की reporting को सही रखें।
4. बिना proof के expenses claim करना
Regular taxation में expense claim करने पर bills, invoices और business purpose का proper record रखना practical safeguard है।
5. New और Old regime की तुलना किए बिना option चुनना
Business/profession income वाले taxpayers के लिए old regime option के साथ Form 10-IEA rules भी जुड़ते हैं।

Freelancer के लिए Simple Tax Record System
हर महीने एक simple spreadsheet या accounting sheet रखें। इसमें Client Name, Invoice Date, Invoice Amount, TDS, Amount Received, Payment Date और Notes जैसे columns रख सकते हैं। Regular taxation use कर रहे हैं तो eligible expenses के लिए अलग sheet बनाएं।

Freelancer को कितनी Income पर ITR File करना चाहिए?
केवल एक “freelancer income limit” देखकर फैसला करना सही नहीं है। Return filing obligation आपकी total income, applicable provisions, special conditions और दूसरे factors पर निर्भर कर सकती है। इसलिए “मेरी freelance income कम है, इसलिए ITR की जरूरत नहीं” जैसी assumption से बचें।

Freelancer और GST का क्या संबंध है?
Income Tax और GST दो अलग tax systems हैं। Freelancing income पर income tax calculation और services पर GST registration/liability अलग सवाल हैं। केवल income tax ITR file कर देने से GST compliance अपने-आप complete नहीं होती। GST applicability turnover, service type, place of supply और registration rules पर निर्भर कर सकती है।
